Discord application

Discord Terms of Use

These terms are an agreement between you and Belal, under the name Deadly, for use of Discord applications we operate. They are the terms to link from the Discord Developer Portal. They do not replace Discord’s own terms, and they do not cover the portfolio website. The website has its own Terms of Use.

In short

  • Inviting the application or using a command means you agree to these terms and to Discord’s rules.
  • If these terms conflict with Discord’s terms on a Discord issue, Discord’s terms control.
  • The application does not charge a fee inside Discord and does not sell virtual currency.
  • A server admin must have authority to add the application. Anyone can remove it or stop using it.

Acceptance

By adding the application to a Discord server, configuring it, or using a command, button, or message with it, you agree to these terms. If you do not agree, do not add the application and do not use its commands.

You also agree to follow the Discord Terms of Service, the Discord Community Guidelines, and applicable law. The Discord Privacy Policy explains how the application handles Discord data. Reading that policy is not, by itself, consent to a new use of your data.

These terms are only between you and the operator. Discord is not a party to these terms and is not responsible for the application. These terms do not change, limit, or replace the Discord Terms of Service, the Discord Developer Terms of Service, or the Discord Developer Policy. If these terms conflict with Discord’s terms on a point about Discord, API data, or use of Discord, Discord’s terms control.

Eligibility

You may use the application only if you are allowed to use Discord. That includes Discord’s minimum age and any higher age required where you live. The application is not directed at children under 13.

If you add the application to a server, you confirm that you have the server permissions and the authority to do that. You are responsible for the settings you save and for the commands you run.

The application

The application provides the commands and features listed on its Discord profile. Those features may include server tools or, where an administrator enables it, a display of game, event, or ranking information that the administrator connects. A description on the profile is the list of what the application offers. It is not a promise of a feature that is not listed.

We may change, pause, or remove a command. We do not promise that the application will be available without interruption.

Acceptable use

You may use the application for its listed features, in line with Discord’s rules and these terms. A server admin may configure the channels and options the application shows for that purpose.

Prohibited use

You may not use the application to:

  • Break the law, or help someone else break the law.
  • Break the Discord Terms of Service or the Discord Community Guidelines.
  • Harass, threaten, or harm another person, or send illegal or abusive content through a command.
  • Spam, flood, or disrupt Discord, a server, or the application.
  • Attempt to access the application, a token, a server, or data without authorization.
  • Probe, scrape, or overload the application, or bypass a limit Discord or we set.
  • Use the application to distribute malware, phishing, or stolen credentials.
  • Misrepresent who operates the application, or imply that Discord endorses it.

We may refuse a command, remove stored settings, or stop providing the application to a server that breaks these rules. Discord may also act under its own terms.

Content you submit

You keep your rights in text, names, and other content you submit to the application. You give us permission to process that content only as needed to provide the feature you or a server admin requested, to keep the application secure, and to meet a legal or Discord requirement.

You confirm that you have the right to submit that content. Do not submit personal information about someone else unless you have a proper basis to do so. We do not claim ownership of your Discord messages or your server.

Server administrators

An administrator who adds the application is responsible for telling server members that the application is present and for the settings they enable. The administrator must have authority to connect any game-server or announcement feature they turn on.

Removing the application from the server ends that server’s use of it and is a request to delete the settings we stored for that server, as described in the Discord Privacy Policy.

Payments and digital items

Using the application inside Discord does not create a purchase. The application does not charge a fee through Discord, does not take donations inside Discord, and does not sell virtual currency or digital items.

Hiring Deadly for development work is a separate agreement. It is not formed by inviting this application or by using a command. The website quote form is covered by the Terms of Use, not by these terms. These terms do not take away a refund right that consumer law does not allow to be waived.

Availability and ending use

The application may be unavailable during maintenance, Discord outages, hosting problems, or abuse prevention. We may stop operating it. We do not offer a service-level agreement.

You may stop using the application at any time. A server admin may remove it at any time. We may suspend or stop service to a user or a server if these terms or Discord’s rules are broken, if Discord requires it, or if we discontinue the application. We do not promise advance notice when we need to stop abuse quickly.

Intellectual property

We own the application’s original code, commands, and branding, unless a notice says otherwise. You receive a limited right to use the application through Discord while these terms are in effect. You do not receive a right to copy the application, resell it, or hold yourself out as its operator.

Discord’s name, marks, and software belong to Discord. Game names, including Silkroad Online, belong to their owners. These terms do not grant a license to Discord’s platform or to a third-party game.

Disclaimers and liability

The application is provided as is. To the extent the law allows, we do not warrant that it will be uninterrupted, error-free, or fit for a purpose that is not one of its listed features. Game results, rankings, and announcements shown by the application can be wrong if the source data is wrong.

To the extent the law allows, we are not liable for indirect or consequential loss, or for loss caused by Discord, a third-party game server, or a server setting an administrator chose. Nothing in these terms limits liability for fraud, for death or personal injury caused by negligence, or for any other liability that the applicable law does not allow to be limited.

These terms do not ask you to waive a right that cannot legally be waived, including a non-waivable consumer right. They do not require arbitration, and they do not bar a claim in a forum where the law says you may bring one. Discord’s own terms may still contain a dispute process between you and Discord. That process is Discord’s, not this agreement.

Indemnity

If you misuse the application, add it to a server without authority, or submit unlawful content, and that leads to a claim against us, you agree to cover the reasonable losses and costs caused by that claim, to the extent the law allows.

This does not require you to cover our own fraud or wilful misconduct, and it does not require you to give up a right that cannot be waived. If a court finds this section too broad, it applies only to the part that remains enforceable.

Changes

We may update these terms by posting a new version on this page and changing the last-updated date. The new terms apply to use after that date. We will not use an update to take away a right the law says cannot be waived, or to override Discord’s terms.

A material change to the data the application collects is also described in the Discord Privacy Policy.

Governing law and disputes

No registered office, country of establishment, or court is published for the operator. These terms do not invent a governing law or a court.

Contact us first so a disagreement can be discussed directly. If a dispute continues, the courts and mandatory laws of the place that actually has authority still apply. Discord’s dispute terms apply only to disputes with Discord.
